Mr. Martin Litwak, Partner, Litwak & Partners

Martin Litwak obtained his law degree with honours from the School of Law of the University of Buenos Aires (Argentina) and his Master’s degree in Finance from UCEMA (Argentina). He is the managing partner at Litwak & Partners, a boutique law firm specializing in investment funds, corporate finance and private client work. Mr. Litwak has broad-based corporate and finance experience. His professional practice is focused on representing investment funds of different types and magnitudes and fund managers based throughout Latin America in all aspects of their operations from their launching to their liquidation. He provides legal advice to these clients regarding structural and organizational matters, as well as ongoing corporate, regulatory and compliance issues. During the past ten years, Mr. Litwak alone has formed hundreds of offshore investment funds, most of them domiciled in the British Virgin Islands and the Cayman Islands, for his clients worldwide. In addition to the above, Mr. Litwak routinely offers professional advice to international financial institutions in structured finance and capital markets transactions for multi-national corporations, including asset securitization, syndicated loans, credit enhanced loan facilities, and trade and project financing. His services also cover a wide range of international transactions, such as cross-border mergers and acquisitions, venture capital and private equity transactions, capital market offerings and debt restructuring transactions. Finally, Mr. Litwak also provides consultancy services to high net worth individuals and families domiciled in Latin America in relation to the structuring of trusts, funds, foundations and other instruments relative to estate planning. Mr. Litwak´s awards and commendations include the following achievements: ranked as one of the best lawyers in private fund formation by Who’s Who Legal (in 2008, 2010 and 2011); included in the “Expert Guides” published by Euromoney, in the sub-category “investment fund lawyers” (2010); listed as one of the best lawyers by Chambers & Partners (subcategory capital markets) in Latin America (2009); recipient of the second prize at the Best Paper Award contest organised by the Inter-American Bar Association (for his paper “Current Trends in the Latin American Hedge Fund Industry. Lessons from the Financial Meltdown”); nominated by Who’s Who Legal as one of the top practitioners in the British Virgin Islands for his work in the formation of private funds (2006); ranked by Who’s Who Legal as a prominent legal practitioner for his work on mergers & acquisitions (2006); ranked among the top ten most promising up-and-coming young Argentinean lawyers by “Infobae Profesional” (2006); and listed by Chambers & Partners in Band 3 of their ranking for BVI practitioners in corporate and commercial law (2006). Mr. Litwak has authored and co-authored over 30 legal articles in Latin America, the United Kingdom and the United States and is a frequent speaker at conferences and seminars held in Argentina, the British Virgin Islands, the Bahamas, El Salvador, Mexico, the United States and Uruguay. He has also been invited by both the UCEMA and the University of Buenos Aires to lecture postgraduate courses on offshore banking and capital markets. Martin also has been frequently quoted by newspapers, legal publications and journals on a wide variety of issues in the investment funds industry. He is a member of the International Bar Association, where he currently serves as president of the committee of international law of the Inter-American Bar Association, and the International Bar Association. He is also a member of “Team BVI”, a board of advisors to the International Finance Centre of the BVI where he heads up the Uruguayan chapter and a member of the board of directors of the Hedge Fund Association (Latin American chapter). Prior to founding Litwak & Partners earlier this year, Mr. Litwak had spent more than twelve years working for some of the most prestigious law firms in Argentina (Abeledo Gottheil Abogados), the British Virgin Islands (Ogier) and Uruguay (Ferrere).
